JCJ Production Studios LLC. – Terms & Conditions Agreement

By booking a session with JCJ Production Studios LLC., the Client acknowledges and agrees to the following terms and conditions:

Payment & Retainer Policy:

Non-Refundable Retainer

A non-refundable retainer is required for all sessions. Retainer amounts are listed on the contact page for each service. This retainer secures your booking and will be applied toward the total service cost.

Remaining Balance

The remaining session fee balance is due in full on the day of your photoshoot. This payment covers anyone employed or under contract with JCJ Production Studios LLC. (photographer, videographer, gaffer, makeup artist, etc) time, retouching, and creative editing of images.

Gallery Delivery

Final image galleries and video files will not be delivered until full payment has been received.

Punctuality Policy:

Late Arrival Policy

To ensure you receive the full experience and value of your session, please arrive on time.

Clients who arrive late to their session will have their tardiness deducted from their scheduled session duration. This may result in fewer proofs.

  • Shoot times are unable to be extended to accommodate late arrivals.

  • No discounts or refunds will be given for lost time.

  • Please be mindful that other clients may be scheduled before or after your session, and delays may impact the overall schedule.

Rescheduling & Cancellations

  • Your retainer allows for one appointment rescheduled. Additional reschedules will require a new retainer unless stated otherwise.

  • If illness or unforeseen circumstances prevent a session from taking place, clients may reschedule no later than 48 hours in advance to transfer their retainer to a new date.

  • Out-of-town sessions are not eligible for rescheduling; however, efforts will be made to arrange a session at the photographer’s location at a later date.

  • No-shows will forfeit their deposit.

  • JCJ Production Studios LLC. is not responsible for refunds or additional shooting time if a session has any minor interruptions. However, if the interruption disrupts a majority of the scheduled session and is out of the client’s and/or JCJ Production Studios LLC.’s control, the client will be entitled to one reschedule at no additional cost, subject to the photographer’s availability.

  • Sessions may proceed in overcast or light rain conditions, but severe weather may impact image quality. Sessions will only be canceled or rescheduled due to inclement weather if safety is a concern or if conditions will significantly affect the final images/videos.

Re-Shoots

Re-shoots, revisions, or refunds are not offered except in cases of:

  • Technical failures or malfunctions

  • Emergencies that arise during the session

  • Situations that prevent the JCJ Production Studios LLC. or its approved professionals from delivering the agreed-upon number of technically proficient images

Re-shoots will not be granted for:

  • Poor clothing, makeup, or hair choices

  • Failure to follow JCJ Production Studios LLC. or its approved professionals’ recommendations or instructions

  • Client Disruptions:

    • If a session is disrupted due to the client’s actions or the actions of individuals they are responsible for. This includes but is not limited to, excessive phone use, frequent interruptions, or distracting behavior from guests, children, or other parties present. Clients are encouraged to ensure a focused and professional environment during their sessions.

Copyright & Usage Rights:

Copyright Ownership

JCJ Production Studios LLC. retains full copyright ownership of all images and videos created during the client’s session. However, clients are granted permission to reproduce and publicly display their images and videos for personal use.

Third-Party Usage & Licensing

Any print publications, video editors, or producers wishing to use these images or videos must request explicit permission from JCJ Production Studios LLC. Requests for usage or licensing must be submitted at least 30 days before the intended publication date.

Restrictions on Alterations & Editing

  • Clients who sell, significantly alter, or edit their images, including but not limited to the use of social media filters and AI technology, without express permission from JCJ Production Studios LLC. may be subject to legal action.

  • Any editing not performed by JCJ Production Studios LLC. or its approved professionals constitutes a copyright violation and may be subject to legal action.

Commercial Use Policies

Acting Headshots & Performance Videos

  • Acting headshots are intended for casting submissions, talent portfolios, and industry-related personal promotion.

  • Self-tape auditions and demo reel scenes filmed by JCJ Production Studios LLC. are provided for personal use in securing representation, auditions, and industry opportunities.

  • If any headshot, audition tape, or demo reel scene is later used for commercial purposes—such as in advertisements, merchandise (e.g., autographed prints), or paid promotional content—a licensing agreement and fair compensation must be arranged with JCJ Production Studios LLC.

  • Clients are unable to alter, resell, or distribute these materials beyond their intended purpose without express permission.

Business Photography & Videography

Business photography and videography are not intended for direct resale, merchandise creation, or other profit-driven distribution. The following guidelines apply to specific types of sessions:

  • Modeling Shoots

    • Personal portfolio use is permitted.

    • Commercial use, such as brand partnerships, marketing campaigns, or merchandise (e.g., prints or NFTs), requires a licensing agreement.

  • Corporate Headshots & Branding Sessions

    • Use for professional profiles, websites, and company marketing materials.

    • Use in paid advertisements, promotions, or third-party resale requires a licensing agreement.

  • Event Photography & Videography (e.g., Weddings, Corporate Events, Private Celebrations)

    • Clients receive personal usage rights for sharing and printing their images/videos.

    • Any commercial or resale use—such as promotional materials for venues, vendors, or sponsors—requires written permission and a licensing agreement.

  • Short Films & Video Productions

    • JCJ Production Studios LLC. retains copyright over all video content filmed.

    • Distribution beyond personal use, including film festivals, streaming platforms, or commercial sales, requires a licensing agreement and fair compensation.

Image Review & Gallery Access Policies:

Headshots & Event Photography.

  • A proof gallery containing all usable* images from the session will be available within:

    • Forty-eight (48) hours for local sessions

    • Seventy-two (72) hours for out-of-town events
      This online gallery will include a "PROOF" vertical watermark on all images.

  • The proof gallery will remain available for one (1) month from the client’s viewing date. After this period, all images will be permanently removed from the photographer’s Google Drive. Clients are responsible for downloading and backing up their files.

    • RAW files are retained for ninety (90) days after the photoshoot. Editing selections must be finalized within this period, as RAW files will be permanently deleted after ninety (90) days. RAW files will not be provided to clients under any circumstances.​

    *Usable images are determined at the photographer’s discretion and exclude duplicates, test shots, and images deemed technically insufficient.

Video Review & Delivery Policies:

Demo Reels

  • Clients will receive one (1) round of revisions for demo reels. Any additional revisions will require an additional fee.

  • The final deliverables will include:

    • The fully edited reel

    • The individual edited scenes, if JCJ Production Studios LLC. filmed them.

  • Clients must download and back up their final videos, as all demo reel footage will be deleted after ninety (90) days from the delivery date.

Self-Tape Auditions

  • Self-tapes will be delivered to the client within twenty-four (24) hours of filming.

  • Expedited delivery is available for an additional fee.

  • JCJ Production Studios LLC. will retain self-tape footage for seven (7) days; after this period, it will be permanently deleted. Therefore, Clients are responsible for downloading their self-tapes before this deadline.

Short Films & Video Productions

  • Review, access, and delivery timelines for short films and larger video productions will be determined based on the details discussed during the pre-production consultation. Specific terms, including revision policies and file retention, will be outlined in the project agreement.

Photo Release Policy:

By booking a session with JCJ Production Studios LLC., the client grants permission for the studio to use images (or variations thereof) from the session for promotional purposes, including but not limited to:

  • Websites

  • Blogs

  • Portfolios

  • Social media

  • Marketing materials

  • Displays

Clients acknowledge that no financial compensation will be provided for such use. JCJ Production Studios LLC. will not sell images to any third party without the client’s explicit consent.

Failure to Perform:

If JCJ Production Studios LLC. is unable to fulfill this contract due to circumstances beyond their control—including but not limited to fire, natural disasters, strikes, unforeseen emergencies, illness, or other Acts of Nature—both parties will make every reasonable effort to reschedule the session.

  • If a reschedule cannot be agreed upon, JCJ Production Studios LLC. will refund the retainer fee, and no further liability shall be incurred.

  • This limitation of liability also applies in cases where photographic or video materials are lost or damaged due to processing errors, camera or media malfunctions, mailing issues, or other unforeseen incidents outside the Photographer’s control.

In the unlikely event that images or videos are lost, stolen, or destroyed—whether due to factors within or beyond the JCJ Production Studios LLC.’s control—liability is strictly limited to rescheduling a new session to complete the agreed-upon services.

  • JCJ Production Studios LLC. is not responsible for issuing refunds or covering any third-party expenses paid by the Client (e.g., makeup artists, stylists, venue fees).

Indemnification & Liability:

Liability Waiver

JCJ Production Studios LLC., including its approved professionals, shall be held harmless from any and all liability for injuries, damages, or accidents sustained by the Client or any participating parties before, during, or after the session.

Client Responsibility:

The Client assumes full responsibility for themselves and/or any other individuals under their supervision present at the session. JCJ Production Studios LLC. or its approved professionals are not responsible for any accidents, injuries, or damages that may occur.

Release of Claims:

The Client waives any right to bring claims, demands, or legal actions against JCJ Production Studios LLC. or its approved professionals related to personal injury, property damage, or any other incident that may arise during the session.

Equipment Damage & Financial Responsibility

The Client acknowledges and agrees to take full responsibility for any damage caused to JCJ Production Studios LLC.’s equipment, including but not limited to cameras, lighting, tripods, backdrops, props, and any other gear used during the session. This responsibility applies to damage caused intentionally or accidentally by the Client, their guests, and/or any other individuals under their supervision.

  • Payment Obligation: In the event of damage, the Client agrees to cover the full cost of repair or replacement within thirty (30) days of receiving an invoice. The amount due will be based on the current market value of the equipment or the official repair estimate provided by a certified technician.

  • Unpaid Damages & Legal Action: If the Client fails to compensate JCJ Production Studios LLC. for the damages within the agreed timeframe, the company reserves the right to pursue legal action. In such cases, the Client will be responsible for all legal fees, court costs, and any additional expenses incurred in the process of recovering the owed amount.

  • Acknowledgment & Liability Waiver: By booking a session, the Client acknowledges that they are responsible and encouraged to ensure a safe environment during the shoot and releases JCJ Production Studios LLC. from any liability related to damages caused by their actions or those of their guests.

Partnerships & Collaborations:

JCJ Production Studios LLC. values transparency, professionalism, and mutual respect in all partnerships and collaborations. To ensure fairness and protect our creative work, all collaborators agree to the following terms:

Proper Credit & Acknowledgment

  • Any work created by JCJ Production Studios LLC. as part of a partnership or collaboration must include proper credit. This includes tagging JCJ Production Studios LLC. in all digital posts and mentioning our name in captions.

  • Credit must always remain visible and unaltered. Removing, editing, or omitting credit is strictly prohibited.

Usage & Alterations

  • Collaborators may not modify, alter, edit, or distort any images, videos, or other media produced by JCJ Production Studios LLC. in a way that misrepresents the original work.

  • Minor cropping for formatting purposes is allowed, but significant changes (e.g., adding watermarks, filters, or AI enhancements) require written approval.

  • Unauthorized commercial use of our work will result in retroactive licensing fees at our standard commercial rates. Failure to pay these fees may result in legal action.

Equipment Borrowing & Responsibility

  • If JCJ Production Studios LLC. lends any equipment as part of a collaboration, the collaborator assumes full responsibility for its care.

  • All equipment must be returned in its original condition. Any intentional or accidental damage will require the collaborator to cover the full cost of repair or replacement within thirty (30) days of the incident.

  • If legal action is required to recover costs, the collaborator will be responsible for all attorney fees and court costs.

Exclusivity & Fair Use

  • Collaborators may not use JCJ Production Studios LLC.’s work to secure deals with direct competitors or enter agreements that exploit our content without our written consent.

  • If a collaboration is intended for non-commercial purposes but later generates revenue (e.g., brand deals, ad placements, merchandise), a licensing agreement and fair compensation must be arranged.

Breach of Agreement & Consequences

  • JCJ Production Studios LLC. reserves the right to terminate any collaboration immediately if the partner violates these terms.

  • Upon termination, the collaborator must:

    • Remove all JCJ Production Studios LLC. content from their platforms.

    • Cease any unauthorized usage of our work.

    • Provide compensation for any damages incurred due to the violation.

Agreement to Terms:

  • All policies outlined in this overall agreement, including but not limited to payment requirements, cancellations, rescheduling, usage rights, liability, and indemnification, shall apply to all photography and videography services provided.

  • Clients are responsible for reviewing these terms before booking and ensuring they understand their rights and obligations.

  • Booking a session constitutes a legally binding agreement between the Client and JCJ Production Studios LLC.

  • Collaborating with JCJ Production Studios LLC. constitutes a legally binding agreement, requiring the collaborator to adhere to all terms and conditions. Any violation of this agreement may result in legal action.

By proceeding with payment, confirming a session, or initiating a collaboration/partnership, the client or collaborator fully accepts these terms.
